Title: Caught, Chapter 5
Rating: R, possibly NC-17 later
Summary: Chloe's decision changes things

Chapter 5

Chloe woke to find herself wrapped safely in Jack's arm. A glance at the clock told her it was almost noon.

Jack felt Chloe when she stirred and decided to give her some space, so he pretended to be asleep.

Glancing up at Jack, she saw that he was still asleep. Not wanting to wake him just yet, but feeling anxious, she unconsciously started making designs on his chest. Smirking, Jack asked "Is there something you want?"

Startled, Chloe grinned at him "Hi" she replied

"Morning" Jack answered.

Frowning slightly, Chloe rolled her eyes "It's almost noon Jack" Then smiling, she let her hand wander a bit lower, watching Jack's reaction with a twinkle in her eyes. "As to the other question, yes, I believe you do have something I want."

Chuckling Jack grabbed her hand and dragged it back up to his chest. "I bet there is baby. But first we need to talk about a few things."

Frowning Chloe muttered "I know." Sighing she leaned back against her pillow.

"What happened tonight Chloe?" Jack asked calmly.

"Morris fell off the wagon, but of course you know that." She told him. "I told him I was leaving. When he asked me where was going to go. I told him that the kids and I were moving in with you and that we were planning on getting married.."


"He had been drinking and he flipped out. Cursing you madly." Turning to look at Jack, she continued. We argued and he hit me, so I gave him a right hook and it knocked him on his ass, unfortunately, it didn't knock him unconscious! I grabbed the kids, my purse and we took off."

"His pride was hurt, Jack. I don't think he realized what he was doing. He just automatically came after me. I suppose he wanted to try to talk me into staying. I didn't want to hear it, so I basically ignored him." Sighing, Chloe looked at Jack. "I got off the main roads and took the back streets. I managed to lose him for a few minutes. When he caught up with me, he took a turn sharply. Too sharply and being drunk as he was, he lost control of the car."

"That's when his car hit yours? Oh, Chloe I am so sorry, I should have been here when you told him" Jack told her calmly. But she knew that he was anything but calm.

"It's not your fault Jack. He is a grown man. Besides, you have a job you have to do in New York, I understand why you were not here." Caressing Jack's cheek, Chloe pleaded "Don't make more out of this okay? I mean, I know you are mad at Morris, but the kids and I are okay."

"I can't do that Chloe." Jack told her. "It is against the law to drink and drive! Besides, he could have killed you or the children."

"But Jack, some of it is my fault." Chloe replied. "I knew, deep down when I agreed to let Morris move in with me because I was pregnant that it wasn't going to work out. When you came back into my life, I knew he would issue an ultimatum. I also knew that I wouldn't chose him."

Before Jack could say anything, Chloe interrupted him, "besides he doesn't know you and I have been together, nor does he know that I am pregnant."

Jack looked at Chloe and replied "I think you need to see the kids. Forget about Morris. Let me deal with that."

When Chloe started to say something, Jack pressed his finger against her lips. "No arguments, young lady."

"Okay Jack." Chloe agreed. "You know what? I am famished, what's for breakfast?"

Chuckling, Jack muttered "That's my girl. So now that you're through arguing with me, you want me to feed you?"

Glaring at Jack playfully, Chloe responded. "Yes, after all I am eating for two."

Sighing, Jack got out of bed, grabbed his jeans and slid them on. Turning back to her, he asked "What do you want?"

"Waffles!" Chloe exclaimed happily.

"Lord help me." Muttered Jack as he headed for the kitchen.

"I heard that Bauer!" Chloe yelled as she closed the bathroom door.

When Jack arrived in the kitchen, Bill was in there making coffee and talking on the phone.

Hearing footsteps, he turned to see Jack coming in. Holding up his cup of coffee, he gestured to him. Jack nodded.

Hanging up the phone, Bill poured Jack a cup. "That was Karen on the phone. Chase & Kim are delayed in Boston due to weather. They won't get here until this afternoon. She stayed with the kids. The doctor just came in. Jake has a sprained wrist, but nothing else. His hand has been wrapped up. Sophia just has some bruises and bumps. They are okay to leave the hospital. I thought it would be okay if Karen brought them here, so that they could see Chloe."

"Thank god there is nothing more serious than a sprained wrist and some bumps and bruises." Jack muttered. "That will be great, I just mentioned to Chloe that she should see the kids."

"Karen is going to take them by our place since its closer to the hospital. Let them clean up. Apparently she bought new clothes and a couple of toys for them." Bill replied grinning.

Chuckling Jack muttered. "Any baby clothes in that stuff she bought?"

"Just say the word, my wife would love to go shopping with Chloe." Bill replied.

"We got any stuff in there to make breakfast with?" Jack asked. "Chloe wants waffles."

Bill replied "I am sure we do, my wife sent Nadia by her with three bags of groceries!"

"I'll cook" Jack said. "You can go clean up if you like."

"First tell me what you found out from Chloe." Bill said.

"It was an accident, Bill. However, Morris had been drinking when he got behind the wheel and went after Chloe. You said something about the fact that they did test his alcohol level at the scene?"

"Not exactly, they tried to administer an alcohol test, but he was pretty banged up, then there was Chloe who was yelling at him and hit him. But they smelled it on his breath and there were bottles in the car." Bill explained.

"I want him charged, Bill." Jack said firmly. "He could have killed them all."

"I will let the officer in charge of the accident know. Most likely Chloe will be the one to actually file the claim against him. Is she willing to do that?"

"Yes." Jack replied.

"Okay." Bill muttered. "One more thing, how did your name get put on the birth certificates as their father? Do you know anything about this?"

"When Chloe and I hooked up six months ago, she introduced me to the kids and explained that I was their father." Jack explained. "She said that Morris had never asked her about the birth certificates and that when they asked her who the father was she told them the truth, that it was me. She was asked if she wanted me or Morris put down on their birth certificates. When they were born, she left it blank, but then after they turned a year old, she said that she had my name added."

"I see." Bill muttered. "Did Chloe mentioned that she hit Morris, after his car collided with hers and that she kept trying to hit him? If it weren't for an officer holding her back, she probably would have killed him herself."

Trying not to chuckle, Jack muttered. "No, she didn't mention that. She did tell me that she hit him with a right hook earlier in the evening."

Bill laughed all the way to bathroom.

Jack turned his attention to the kitchen and that stove.

Twenty minutes later, he heard a car drive up.

The front door opened to the sounds of "Mommy!"

He could hear Karen as she tried to control the kids. "We have to be quiet. Your mom may still be asleep and we don't want to wake her, do we?"

"But I want to see my mommy." Chimed a little girl.

"I know you do honey. Why don't we see what's for breakfast? I smell something good." Karen said as she tried to distract the kids.

Smiling, Jack popped his head around the corner. "its okay, Chloe is in the shower. I am in charge of breakfast. So, who wants what?"

Seeing Jack, the kids ran straight for him. "Daddy!" they chimed as they hugged his legs.

Jack was caught off guard by this.

Karen laughed at the startled expression on his face. "Better get use to it, daddy Bauer."

Jack tried to glare at Karen. "You and Bill are enjoying this, aren't you?"

"Lord yes!" Karen exclaimed. "We haven't had this much fun in awhile. Besides as I hear it, we are your official "grandparents."

"Oh God!" Jack groaned. "Alright, who wants blueberry pancakes?"

"Me!" came the chime from down around his knee.

"Okay, here is the deal. You have to have one egg, orange juice and milk with your pancakes, okay?"

Nodding their heads vigorously, Jake and Sophia bounded into kitchen.

Having been momentarily released, Jack pointed his spatula down the hall. "Your husband is in the guest bathroom."

"Thank you Jack, We both will have what they are having, only skip the pancakes for us and make it an omelet with cheese and toast." Karen replied as she headed down the hall.

The kids were half-way through their breakfast when Chloe came wandering into the room. She stood for a moment, watching her kids, Jack, Karen and Bill eating at the table.

She felt so happy she could cry. Damn her hormones she thought, as she felt tears forming in her eyes.

Jake looked up and noticed her standing in the doorway.

"Mom" he jumped up out of the chair and ran into her arms.

Hearing Jake, Sophia followed suit. Chloe had one child in her arms and another attached to her leg.

"You guys leave any food for me?" She asked.

They both nodded.

"Good, I'm starved." Chloe replied.

Karen got up and relieved her of the kids, who went back to eating breakfast.

Jack slid a plate full of blueberry pancakes in front of Chloe.

Frowning, Chloe muttered. "Didn't I order waffles?"

"No waffle iron. Eat your pancakes, young lady and no arguments." Jack told her.

Glaring at him, Chloe asked "Are you always this bossy? Or is it because I am pregnant?"

Looking at her, Jack replied "Yes and Yes."

"Is it going to be like this the whole time I am pregnant?" Chloe whined.

"Yes, because I know you." Jack assured her with a grin.

"I hate you Bauer." Chloe grumbled as she dug into her pancakes.


Morris came to and found himself in a hospital bed. "Jeez how the hell did I get here?" he mumbled.

"By getting into your car drunk and crashing into Chloe's" replied a voice from the corner of the room.

"Jack? Accident?" Morris inquired. "What do you mean? I don't remember crashing into Chloe. I do seem to remember her hitting me and my head hitting the edge of the counter."

Stepping up to the bed next to Morris. Jack replied. "Well if you hadn't been such a drunken jack-ass, maybe she wouldn't have hit you. You ever think of that?"

Feeling his head throbbing, like someone was banging a hammer inside it, Morris groaned. "Go away Bauer, I've got nothing to say to you. What goes on between me and Chloe is not your business."

Stepping in closer, Jack snarled. "Oh you are very wrong about that. See, I plan to marry Chloe. The fact that Jake and Sophia are MY kids, as well as the one Chloe is currently carrying, it damn well makes it my business."

Frowning up at Jack, Morris blustered. "What the hell are you babbling about? Your wires get crossed during your stay in China?

Tossing a bunch of papers at Morris, Jack smugly replied. "You're lucky you are in a hospital bed. Don't believe me, take a look for yourself, asshole."

Sputtering Morris, picked up the papers. Recognizing two of the as birth certificates, he looked at one.

Noticing what Morris was looking at, Jack pointed his finger to the lines on the page that listed birth mother and birth father.

"Hmm.. birth mother, Chloe O'Brian. Birth father, Jack Bauer. Right there in black and white. Apparently it took my sperm to knock Chloe up and not you." Jack retorted.

"This can't be right." Morris replied. "You had these forged Jack."

Laughing, Jack replied. "Look at the documents Morris. Both of them have official seals from this hospital on them and at the top of the documents each one reads official document, not a copy. Nice try."

Getting angry, Morris turned to another piece of paper. Looking at it, it was a police report. "What the?" He muttered. "This says that I hit Chloe's car and that the kids were in the car at the time. I am being charged with DUI, reckless driving and endangering welfare of children."

Snarling, Jack replied. "That's right. You did all of that last night. Your alcohol level was twice the limit. Between that, your previous infractions and the fact that Chloe is filing charges against you, I would daresay that you might get some time behind bars."

"Jack that's enough." Chloe muttered from the door of the room.

Turning to look at her, Jack asked. "What are you doing here? I thought we agreed that I would deal with this."

"No, you decided that." Chloe replied. "I never agreed, besides I want to have a word with Morris. Five, maybe ten minutes. Please Jack?"

"Okay. I will be right outside if you need me." Jack said.

"Thank you." Chloe replied.

Looking at Morris, Chloe started talking before he could say anything.

"Everything Jack said is true, Morris. I have to file charges against you. You could have killed my children and that is unacceptable to me."

"Chloe, love, you know that I never meant to hurt you." Morris said.

"I know that. But you've known for a year now that your drinking is out of control. You knew that when I threw you out." Chloe explained. "You know, I cared about you, once. But in the last couple of years, I've come to realize that I don't anymore. Because no matter what you or do, you always go back to being the same-old Morris who drinks."
"So it's Jack you love now, I suppose?" Morris said sarcastically.

Sighing, Chloe responded. "That is a stupid question Morris. You know how long I've loved Jack. Even when I stayed with you because I thought he didn't feel the same way about me. Well you were wrong about that. He feels the same way I do. And furthermore, I am not terrible at sex! As a matter of fact, I am pretty damn good at it and so is Jack!"

Taking a deep breath, Chloe continued. "It's true, Jack is the father of Jake and Sophia. The first time we did it was when he was on the run and supposed to be dead. I never told you, because it was just one of those things that happened and we both were with other people."

"I see." Morris muttered. "Anything else you care to tell me?"

"No. I just want you to leave me alone. Leave us alone. Deal with your problem and find someone who cares about you." Chloe said sadly.

"Chloe, I've always loved you. No matter what." Morris said. "I've never felt that way about anyone."

"I know." Chloe replied. "But, it's over, okay. If you don't stay away, I won't be able to control Jack."

Morris nodded as tears rolled down his face.

"Goodbye, Morris."
